The Family and Medical Leave Act (FMLA) is a federal law that was enacted in 1993. Its purpose is to provide job-protected leave for eligible employees who need to take time off for certain family or medical reasons.
The FMLA applies to employers with 50 or more employees and requires them to provide eligible employees with up to 12 weeks of unpaid leave per year for certain reasons, such as:
The birth or adoption of a child
The care of a spouse, child, or parent with a serious health condition
The employee's own serious health condition
A qualifying exigency arising out of the fact that the employee's spouse, child, or parent is a covered military member on active duty or call to active duty status.
The FMLA also requires employers to maintain group health insurance coverage for employees who take leave under the Act, and to restore employees to their previous position or an equivalent position upon their return from leave.
The FMLA is enforced by the U.S. Department of Labor (DOL), and employees can file a complaint with the DOL or file a lawsuit against an employer who violates the Act. The law has been amended over the years to include additional types of leave, such as military caregiving and military exigency leave, but the basic principles of the law remain the same.
